New twist in Tyrian case after CJ disowns order

Isalamabad High Court has issued a statement saying that the order of two judges dismissing the Tyrian White case was uploaded illegally.

The statement said that the order of two judges cannot be considered the judgement of the court.

“Today, without the announcement of judgement or issuance of cause list for announcement or otherwise intimation to parties or their counsel and without sign of third member (Hon’ble Chief Justice), the opinion of two judges was uploaded with office notes, which does not constitute judgement of this court and is against the rules and the norms,” the statement read.

The order has now been removed from the court website. The bench hearing the case will be reconstituted.

It also said that action will be taken against those responsible for uploading the judgement.

The order

Earlier in the day, an order sheet written by Justice Mohsin Akhtar Kayani was uploaded to the IHC’s website. It also carried the name of Justice Arbab Muhammad Tahir as having concurred with Justice Kayani’s order, although the order did not carry the signatures of either judge.

“… instant writ petition is not maintainable from the very inception, the same is hereby DISMISSED,” Justice Kayani had wrote.

“The petitioner, through the instant false and vexatious petition has attempted to re-agitate the questions which were already adjudicated by this Court.”

“Should we start conducting involuntary DNA tests in every such petition believing the assertions as true by intruding the liberty and privacy of people? Should we promote negative practices and instead of uplifting civilization and moral standards, contribute to degeneration of the society? The answer is a big “NO”,” the order read.

The Tyrian White case

The Tyrian White case had sought Imran Khan’s disqualification on the grounds that he is no longer Sadiq and Ameen because he did not declare a dependent daughter in his nomination papers.

The case had been filed by a private citizen named Muhammad Sajid, but had been the basis of plenty of criticism from PMLN and other parties.
