PTI chief Imran Khan is likely to be moved to Adiala Jail in Rawalpindi as the Federal Investigation Agency has filed the cipher case in Islamabad, a legal expert said.

Before the Islamabad High Court’s verdict in the Toshakhana criminal case, Advocate Shah Khawar told BBC Urdu that the PTI chief would find it hard to go free despite the court’s ruling to suspend his sentence.

Khan’s three-year sentence in the Toshakhana criminal case was suspended by a two-member bench of the Islamabad High Court.

The IHC Chief Justice Aamer Farooq announced the decision at around 1pm. He said that a written order was being prepared and soon it would be released, containing the reasons for the suspension of the sentence.

The high court has ordered the PTI chief to submit worth Rs100,000 surety bond.

However, an anti-terrorism court ordered the jail authorities on Tuesday to keep Khan in judicial lockup and produce him before it on August 30.

The FIA arrested the PTI chief in Attock Jail for investigation in the cipher case, Khawar said, adding that despite the suspension of his sentence, Khan would remain in detention in other cases.

For him, the Home Department will decide if Khan was incarcerated in Attock Jail or if he would be shifted to another prison facility. The authorities can keep a convict in any jail as they find it appropriate, Khawar stated.

There is a possibility the authorities shift him to Adiala Jail or try him in Attock Jail in the cipher case given the security issues he added.

PTI’s legal aid Shoaib Shaheen said that as per rules the PTI chief should be given time to apply for bail in other cases after his release from jail in the Toshakhana case.

However, it is not known what the government will do in the next moment, he added.
