PTI’s Hasan, nine others sent on 14-day judicial remand

Hasan to undergo medical examination at Pakistan Institute of Medical Sciences

An Islamabad district and sessions court sent PTI Information Secretary Raoof Hasan and nine other individuals on Tuesday on a 14-day judicial remand in a case related to the party’s alleged “anti-state digital campaigns”.

Judge Muhammad Shabbir also directed that Hasan undergo a medical examination at the Pakistan Institute of Medical Sciences (Pims) before being sent to jail, as the PTI leader had complained of “severe heart pain”.

Hasan was arrested last week during a police and Federal Investigation Agency raid on the PTI’s Central Office in Islamabad. He and several party members were booked under the Prevention of Electronic Crimes Act 2016 (Peca).

The 10 suspects, comprising nine people arrested on July 22 and Liaqat Ali who was arrested on July 24, were presented before the magistrate on Tuesday. PTI lawyers Ali Bukhari and Ali Zafar represented the suspect, while Sheikh Aamir appeared as the FIA prosecutor.

The FIA prosecutor informed the court that a “technical report has been received” and that all “suspects were in contact with each other”. But Zafar argued that PTI’s Hasan and the others had already been remanded into FIA custody for seven days. He also requested that his client’s medical check-up be conducted, stating that “Raoof Hasan is not well”.

The prosecutor sought another five days of physical remand for the suspects, but the judge denied the request and instead ordered a 14-day judicial remand for Hasan and the nine others.

In the written order, Judge Shabbir noted that the suspects had not “complained of any maltreatment at the hands of the IO”.

The judge observed that the investigation officer had “not requested the physical remand of accused on the ground of recovery in the purview of Section 167” of the Code of Criminal Procedure (CrPC). The judge asserted that “no convincing ground could be advanced for grant of further physical remand” and directed the suspects to be presented in court on August 13.

The judge also ordered the IO to submit a report under Section 173 (report of police officer) of the CrPC within the stipulated period.

While noting that Hasan “complained that he is feeling not well and suffering from severe heart pain”, the judge directed the IO to have Hasan “medically examined from Pims Hospital before sending him to judicial lock-up”.
