PMLN files appeal against reserved seats case decision

Petition maintains that the 15-day period granted is against the law

The Pakistan Muslim League-N (PML-N) has filed a review petition in the Supreme Court, challenging its earlier decision to award reserved seats to the Pakistan Tehreek-e-Insaf (PTI).

The petition, filed by the PML-N, names 11 parties as respondents, including the Sunni Ittehad Council, Hamid Raza, and the Election Commission. It seeks a stay order on the Supreme Court’s July 12th decision and requests a review of the judgment.

The petition argues that the PML-N is the largest political party in the Parliament and that the Supreme Court’s decision should be reconsidered. It further claims that the PTI did not request the allocation of reserved seats and that the Sunni Ittehad Council and the PTI are separate political entities.

The petition also highlights that independent candidates had already joined the Sunni Ittehad Council before the Supreme Court’s ruling.

The petition further states that the members declared as belonging to the PTI had identified themselves as independent candidates in their nomination papers and that the 15-day period granted to independent candidates to join a party is against the law.

It emphasizes that according to the constitution, independent candidates can only join a party within three days. The petition also criticizes the Supreme Court for not hearing the arguments of all parties before awarding the reserved seats to the PTI.

The PML-N has requested the Supreme Court to review its decision on the allocation of reserved seats and to issue a stay order on the decision until a final verdict is reached.

It is worth noting that on July 12, the Supreme Court, in an 8-5 majority decision, declared the Peshawar High Court and Election Commission’s decisions on the reserved seats invalid and declared the PTI eligible to claim the seats.

The Supreme Court’s decision was met with mixed reactions, with the PTI celebrating the victory while the PML-N and other opposition parties criticized the ruling. The review petition filed by the PML-N is expected to further intensify the legal battle over the reserved seats.
