Legal experts weigh in on govt decision to ban PTI
Following the Pakistani government’s announcement to ban the Pakistan Tehreek-e-Insaf (PTI) party, legal experts have expressed their opinions on the legality and implications of the decision.
Retired Justice Shaiq Usmani stated that while the government has the authority to ban a political party under the constitution, it is mandatory to send a reference to the Supreme Court for final judgment.
He explained that under Article 17 of the constitution, any individual can join any party, but a ban can be imposed if the party engages in activities against national security.
Usmani further clarified that the government must conduct investigations and prepare a report before sending it to the Supreme Court for a final decision.
Meanwhile, renowned lawyer and legal expert, Aitzaz Ahsan, has condemned the government’s decision, calling it “foolish.” He believes the reference for the ban is being presented with malicious intent and will backfire on the government.
Ahsan pointed out that the government’s actions are a diversionary tactic to deflect attention from the “Form 45” issue, where allegations of irregularities in PTI’s funding have been raised. He believes those responsible for any discrepancies in the form will ultimately face consequences.
The government’s announcement to ban the PTI came during a press conference where Federal Information Minister Atta Tarar stated that the party and the country cannot coexist. The decision to seek a review of the Supreme Court’s ruling on reserved seats in the recent elections was also announced.
