Imran asks court to overturn disqualification handed in Toshakhana case
Former Prime Minister Imran Khan has approached the Islamabad High Court to overturn the trial court order that found him guilty in the Toshakhana case. With the prison sentence against him already suspended, the move is mainly aimed at overturning his disqualification.
The petition, filed through Latif Khosa, has argued that an appeal had been filed against the Toshakhana case verdict in the IHC, however, the court only struck down the prison sentence and fine and not the trial court order.
Khan has argued that due to the trial court order still being enforced, there is an omission in the order – Khan’s disqualification which has been notified by the Election Commission of Pakistan still applies to him.
The petitition also argues that the ECP acted in malafide intention and adds that it has already been shown that the trial court acted in haste while delivering the Toshakhana verdict.
The petition also requests the court to make the state a party in the case.
Imran Khan was arrested in the Toshakhana case on August 5. Despite the prison sentence being overturned on August 29, he was not released as he had already been arrested in the cipher case.
