IHC decides to hear cipher case bail plea in open court with a caveat

The hearing on Khan's bail plea will be held on October 9.

The Islamabad High Court (IHC) has ruled that it will hear Imran Khan’s bail plea in the cipher case in an open court, as requested by the PTI, but the court will go in-camera whenever sensitive documents are brought up.

The IHC on Wednesday issued a judgment it had reserved earlier this week.

The court will be hearing Khan’s plea for bail in the cipher case registered against him under Official Secrets Act. The original case is being heard by a special court set up at the anti-terrorism court in Islamabad.

The IHC had reserved its decision earlier this week on FIA’s plea seeking an in-camera hearing on the PTI chief’s bail application in the cipher case. The PTI had opposed the plea and sought an open court hearing.

The IHC said on Wednesday that an open court hearing on the bail petition will be held on October 9.

The court said that whenever sensitive documents are brought up in the court, the court will go in-camera. In other words, that particular part of the hearing will not be reported.

The FIA on Monday told the court that public hearings could reveal the contents of secret documents and harm Pakistan’s diplomatic relations with other countries.

Earlier, on Wednesday the special court adjourned the hearing of the cipher case against Imran Khan and Shah Mahmood Qureshi till October 9.

The hearing was held in Adiala Jail where both are incarcerated.
