SC Bans The Words Offensive To People With Disabilities.
In a case against Punjab government regarding its PWDs (persons with disabilities) recruitment for the post of Senior Elementary School Educator (SESE) Arabic, Mr. Justice Syed Mansoor Ali Shah bans the words "disabled," "physically handicapped" and "mentally retarded" as they deeply affront the affectees.
On 14th of July 2020, while adjudicating a case concerning the employment issues faced by disabled persons, Mr. Justice Mansoor Ali Shah issued a 12-page order in which it was stated,
The Federal Government and the Provincial Governments are directed to discontinue the use of these words in official correspondence, directives, notifications and circulars and shift to “persons with disabilities” or “persons with different abilities”
The verdict is significant in Pakistan's history because now the courts have started acknowledging people with different abilities. Our constitution doesn't discriminate, rather it acknowledges the inherent dignity of a human being but the people associate stigmas when it comes to people with physical or mental issues. By using labels for people with different abilities, we make them vulnerable to discriminations and stigmas. To avoid emotional and social withdrawal, SC's order is in the interest of people with different abilities.
