LHC refers petition challenging Punjab property law to relevant bench
The Lahore High Court on Monday referred a petition challenging the Punjab Protection of Ownership Act 2025 to the relevant bench after the court holidays.
Justice Faisal Zaman Khan of the Lahore High Court heard the petition filed by Pakistan Tehreek-e-Insaf lawmakers.
During the hearing, Justice Khan questioned the petitioner’s counsel, Azhar Siddique, about the reasons behind filing the petition.
The court noted that despite widespread social media trolling, it had agreed to take up the petition filed by two PTI members of the provincial assembly (MPAs).
The judge asked whether these MPAs had raised their voice against the law in the assembly.
The court noted that the petition had been shared widely on social media, which risked turning a serious issue into a political controversy.
Justice Faisal Khan advised Azhar Siddique to consider withdrawing the petition, saying that the petition filed on behalf of the victims would have made sense, but in the existing circumstances, it was disappointing and regrettable.
The petition argues that the property law violates the Constitution by giving district authorities control over property, preventing parties from being represented by lawyers in dispute resolution committees, and limiting the scope of courts.
The petition urged the court to declare the act unconstitutional and void.
The court has scheduled the petition to be heard by the relevant bench after the court holidays.
