Supreme Court rules SJC can continue proceedings despite judges’ resignation
The Supreme Court on Wednesday declared that the Supreme Judicial Council can continue proceeding against the apex court judges despite their resignation or retirement.
The court announced a reserved verdict on the case after a 5-member bench led by Justice Aminuddin Khan heard the case regarding the SJC proceedings against retired or resigned judges.
The court gave the verdict 4-1 with Justice Syed Hasan Azhar Rizvi disagreeing with the majority of the judges.
According to the verdict, the proceedings against SC judges will continue even if they resign or retire from their posts.
The verdict was related to an intra-court appeal of the federal government against its judgment delivered in 2023 in Afia Sheharbano Zia’s case.
The petitioner pleaded that the judges who retire or resign do not fall within the ambit of Article 209 of the Constitution that determines misconduct of the superior court judges.
