Nothing less than a full court, demands Nawaz Sharif

PML-N supremo wonders what is stopping CJP from forming a full court

PML-N supremo Nawaz Sharif has said that his party would not accept any decision by a divisional bench on the PTI’s petition against the Election Commission of Pakistan’s decision to postpone elections to the Punjab Assembly till Oct 8.

“We have full trust on the full court,” he said at a press conference on Friday in London, United Kingdom. The former prime minister spoke about the ongoing case in the apex court related to the PTI’s petition and suo motu taken on delay in Punjab and Khyber Pakhtunkhwa elections.

The presser comes as the apex court bench, constituted to hear the PTI’s petition, further diminished after Justice Jamal Khan Mandokhail recused himself from being part of the bench. His recusal came a day after Justice Aminuddin Khan withdrew himself from the five-judge bench.

Pakistan, as described by many experts, is going through another crisis after struggling to keep its economy afloat and managing the security situation.

Sharif wondered why the full court was not being constituted despite reservations from many circles, including the judges part of the actual bench. He asked about the reasons and logic behind keeping the three-member bench.

Many experts said that the same judges were made part of SC benches to hear high-profile cases while at least two of the senior apex court judges were “ignored”.

Sharif, who was disqualified in the Panama case by a five-member bench in 2017, quoted recent statements and audio leaks of judges while saying that such revelations proved that he was treated unfairly.

Such benches have led the country to the prevailing crisis, he alleged.

“Just for a man you are giving such decisions and you have no care for… did you bother to take suo motu on what Justice Shaukat Siddiqui said and former army chief Gen Qamar Javed Bajwa said that injustice was made with Nawaz Sharif and a wrong decision was given for him,” he said.

The former prime minister went on to say that “everyone now” had similar views but no suo motu was taken on his case while it was taken on the delay in elections. He alleged that matters were being run at whims.

The PML-N supremo was of the view that contempt of court proceedings should be started after Justice Mazahar Ali Akbar Naqvi’s name surfaced in connection with an alleged audio leak.

“I think Justice Mazahir’s case should go in the Supreme Judicial Council,” he said.

Three audio clips, featuring former Punjab chief minister Pervez Elahi were leaked on social media on February 16. In one of the clips, Pervez was allegedly heard talking to the judge before whose bench he wanted a corruption case to be fixed. In another clip, his voice could be heard telling the judge that he was coming to meet him.

“A man is known by the company he keeps,” Sharif said on a query pertaining to a judge.
