Police remands Lower Dir woman for "false" rape allegations against judge

A woman from Rahimyar Khan who had alleged that senior civil judge of Lower Dir District raped her in his official residence last month was remanded by a court in police custody for three days for falsely accusing the judge of sexual assault.

Jamshed Kundi was arrested last month after the woman had launched a complaint against him. However, he secured bail and was cleared after a joint investigation. The judge’s suspension was also removed by the Peshawar High Court.

On Wednesday, senior civil judge Essa Khan Afridi sought the woman’s seven day physical custody, but the judge remanded her in police custody for three days and instructed them to question her in prison in the presence of a jail officer and a woman police officer.

The woman was arrested under sections 419, 420, 389, 500 of the Pakistan Penal Code for cheating by personation and fraud and accusing a person of an offence for extortion and defamation, and Section 22(2) of the Anti-Rape Act for giving false information to the police after Kundi had registered a written complaint on December 19th.

According to Dawn.com, Kundi’s application stated the woman along with her partner Aqeel Nadir Khan blackmailed him to extort 15 tolas of gold. When he refused, they accused him sexual assault.

Kundi also said that the woman had taken on a false identity before the police to while accusing him of rape. She also testified in court on November 27th using the same identity.

This led to the cancellation of FIR the woman had registered against Kundi.

Afridi issued the cancellation order and raise questions about how the police handled the case. “Had the local police taken a little pain of collecting evidence prior to the arrest of the accused judicial officer, which is the mandate of the law, the judiciary would not have faced embarrassment,” the order read.

The woman had registered an FIR against Kundi on November 25 at Balambat police station, which said the judge demanded Rs1.5million from the woman three months ago in return for getting her sister a job. The woman didn’t have the amount, so she gave the judge her jewellery worth Rs1.5 million.

The FIR stated that Kundi called the woman on November 25 to tell her he couldn’t get a job for her sister. He asked her to come to his house in the Balambat area so he could return her money. When she reached his residence Kundi served her tea then asked for sexual favours to get her money back. When the woman refused, Kundi raped her.

The DPO Irfanullah Khan said, “The medical report of the complainant has corroborated the rape.” Kundi has been charged under Section 376 (punishment for rape) of the Pakistan Penal Code.
