Constitutional bench demands report over audio leaks commission

A seven-member Supreme Court constitutional bench, headed by Justice Aminuddin Khan, has adjourned the hearing on the audio leaks commission case until next week, pending a report from the federal government.

The court has directed the Attorney General to obtain instructions from the government and inform the court about the government’s intentions regarding the commission.

Justice Aminuddin raised concerns about the commission’s current status, noting that its chairman has retired and another member has been appointed as a Supreme Court judge, questioning whether the commission remains a live issue. He further stated that the formation of a new commission would render the current case moot.

The Attorney General requested time to seek instructions from the government on whether it intends to form a new commission. Justice Muhammad Ali Mazhar pointed out that the cabinet’s decision to form the commission still stands.

Justice Jamal Khan Mandokhail questioned whether the government would consult the Chief Justice in nominating judges for the new commission, a point the Attorney General argued was not legally mandated. Justice Mandokhail emphasized the court’s authority and raised concerns about the potential implications if the Chief Justice refused to provide judges for the commission.

The court’s decision to seek a government report and adjourn the hearing highlights the uncertainty surrounding the future of the audio leaks investigation and the potential implications for the ongoing Supreme Court case.
