Jutice Mazahar Ali Naqvi has written an open letter accusing Chief Justice Qazi Faez Isa of bias and violation of law in proceeding against him in the Supreme Judicial Council.
The four-page letter recounts that he has repeatedly expressed a lack of faith in the proceedings and has asked for the recusal of three judges from the SJC, to no avail.
“An inconvenient truth is still the truth and so I will state it just the same: the treatmentoffered to me by the Chairman and the members of the SJC is nothing short ofdisgraceful,” he wrote.
He also said that he has already filed a case in the Supreme Court against the SJC proceedings, but the matter has still not been stayed.
“The Chairman of the SJC is in blatant, apparent, untethered and repeatedviolation of the law, of my fundamental rights under the Constitution of Pakistan,” he wrote.
“This act alone is enough to prove a case of rigorous bias against the Honourable ChiefJustice of Pakistan.”
He also questioned why the reference was proceeding against him despite the fact that his assets are declared while Justice Isa remains immune despite his undeclared properties.
Naqvi also wrote that Justice Isa had requested the recusal of Justices Ijazul Ahsan and Sardar Tariq Masood during proceedings against him but the same was not being afforded to him.
He also referred to a recent letter by Justice Ijaz ul Ahsan regarding the formation of a bench against the rules outlined in the Practice and Procedure Bill and the against the agreement in the meeting of the committee.
The letter adds that the matter hasis now about the reputation of the Supreme Court itself.
“This is, therefore, a letter to make it known that it is not a matter of my person now, it is a matter of principle – my issue is now an issue of the institution,” he added.
