The constitutional amendment will change rules for voting against party lines

A proposed constitutional amendment seeks to provide sweeping protections to the Election Commission of Pakistan (ECP), its members, and lawmakers who vote against their party lines. The amendment also aims to limit the judiciary’s power to question the ECP’s decisions and the government’s actions.

The proposed amendment, if passed, would grant the Chief Election Commissioner (CEC) and ECP members the right to continue serving beyond their term until their replacements are appointed. This provision would be added to Article 215 of the Constitution.

The bill also proposes amendments to Article 63A, which deals with defection. The amendment would allow votes cast against party directives to be counted, effectively protecting lawmakers who vote against their party lines. The bill further states that no court can question the actions of a member who crosses the floor.

Furthermore, the amendment proposes to limit the judiciary’s power to question the government’s actions. It states that no court can question the advice given by the cabinet or the Prime Minister to the President. The amendment also reiterates Article 68 of the Constitution, which prohibits the conduct of judges from being debated in parliament.

The draft amendment also introduces a provision allowing former ECP members and the CEC to be reappointed for a three-year term after securing resolutions from both the National Assembly and the Senate.
