Reserved seat case: SC Committee defers fixing PML-N’s petition

The Court has formed three-judge committee under SC Practice and Procedure Act 2023

The three-judge committee established under the SC Practice and Procedure Act 2023 committee deferred a proposal to fix the PML-N’s petition against the July 12 short order in the reserved seat case on Thursday.

Instead, the committee, consisting of Chief Justice Qazi Faez Isa, Justice Syed Mansoor Ali Shah, and Justice Munib Akhtar, suggested fixing the review petition for hearing after two months, following the court’s annual vacations.

The committee also suggested that the review petition should be heard by the same 13-judge full court bench that initially decided the matter.

Justices Shah and Akhtar may not be available during the summer vacations.

On July 12, a 13-judge full bench of the Supreme Court had ruled that the opposition PTI was eligible to receive reserved seats for women and non-Muslims in the national and provincial assemblies.

In its petition, the ruling PML-N has argued that the Supreme Court, instead of interpreting the Constitution, had encroached upon the domain of legislation. The PML-N’s plea, filed through Barrister Haris Azmat, requests the Supreme Court to not only recall the judgment by reviewing it, but also suspend its operation until the matter is resolved.

The PML-N’s review petition has maintained that the July 12 short order was against the settled principles of interpreting the Constitution.
