Court reserves decision on PTI chief’s petition against Toshakhana verdict
A two-member bench of the Islamabad High Court reserved its decision on PTI chief Imran Khan’s plea on Monday, seeking cancellation of a three-year prison sentence in the Toshakhana case.
A division bench comprising IHC Chief Justice Aamer Farooq and Justice Tariq Mehmood Jahangiri presided over the hearing. The decision will be announced on 11 am on Tuesday, Khan’s layers were told.
Election Commission of Pakistan’s lawyer Advocate Amjad Pervaiz appeared in court and presented his arguments. Khan’s lawyer Latif Khosa was also present in court.
The previous hearing of the case on August 25 was adjourned after Pervaiz failed to appear in court, citing that he was “extremely unwell”. The hearing was adjourned till August 28.
Pervaiz argued in court that Khan’s lawyers had turned ECP and session judge into a ‘villain’.
When Justice Farooq asked Pervaiz what points he wanted to argue on, Pervaiz said he wanted to explain three main points, jurisdiction, duration of complaint and right to defence.
Meanwhile, the cause list of the Supreme Court on its website showed that CJP Bandial would not hear any routing cases this week.
The court in the previous hearing while addressing Khan’s lawyer, Latif Khosa, said that the court the division bench did not hear cases on Friday but had come to the court only for this case.

Moreover, the Supreme Court while hearing a host of Khan’s petitions in the gifts case said that the Islamabad sessions court judgement against the PTI chief was “flawed”.
Chief Justice of Pakistan Umar Ata Bandial had remarked that “in hindsight, the trial court gave a decision in a single day which was not correct, there are flaws in the decision of the trial court, in hindsight. We are not interfering in this matter now. Let the High Court decide tomorrow [August 24]. We will hear the case tomorrow.”
On August 24, the Supreme Court sought a report on the condition of the PTI chief in his jail cell by Monday.
The Supreme Court’s order, released later in the day, said that it would be appropriate to wait until the high court issued its order in the case. But the SC also asked the attorney general to submit a report of the conditions Imran Khan was being kept in the Attock Jail. The report was to be submitted by August 28.
