Toshakhana case judge transferred to Islamabad High Court

Humayun Dilawar, who convicted PTI Chairman Imran Khan in the Toshakhana criminal case was posted at the Islamabad High Court as an Officer on Special Duty (OSD) on Friday.

Dilawar has been instructed to report to the Islamabad High Court. He will join his new assignment with immediate effect. He was working as an Additional District and Session Judge (West), Islamabad.

Dilawar had requested his transfer to the Federal Investigation Agency after facing threats from the PTI workers.

A copy of his letter to Registrar of IHC, available with Aaj News, alleged that an organised social media campaign was orchestrated against him and his family.

“The undersigned has recently rendered a judgment in criminal Complaint under section 190 of Election Act 2017 in respect of offenses under sections 167& 173 Of the Election Act 2017 along with all other enabling provisions of Law, titling District Election commissioner Islamabad Versus lmran Ahmad Niazi, convicted the accused who is the chairman of a political party,” the letter said.

Dilawar went on to add a campaign on social media was launched against him leading to serious threats from different people across the world during trial and after passing the judgment.

“Even my family in my native town received threats from beyond the border. My children are also facing hardship in moving to school and facing an unpleasant situation.

Similarly, during a recent visit of the undersigned to the UK to attend Training at the University of Hull. the undersigned and other judicial officers had to undergo a displeasing episodes.“

He requested that he be transferred to any other place of posting preferably in special courts located in the Judicial Complex G-11/ or Islamabad High Court.

While serving as Additional District and Session Judge in Islamabad, he slapped the PTI chief with a five-year disqualification and three-year prison term in the Toshakhana criminal case.

Dilawar, who sentenced PTI chief Imran Khan to three years in prison flew to the United Kingdom to participate in training on August 5.

He was set to attend the ‘Judicial Training on Human Rights and the Rule of Law’ from August 5 to August 13. Islamabad High Court Chief Justice Aamer Farooq nominated him for the training.

It is pertinent to mention that the Supreme Court of Pakistan found ‘flaws’ in his judgement against Khan that led to his sentencing and imprisonment. However, it decided against intervening immediately.

The top court heard a host of petitions filed by Imran Khan in the Toshakhana case on August 23.

One of the pleas challenged the session court judgment and another called into question the decisions of the Islamabad High Court.

During the hearing, Chief Justice Umar Ata Bandial remarked that ’in hindsight, the trial court gave a decision in a single day which was not correct, there are flaws in the decision of the trial court, in hindsight.
