Toshakhana case: Court reserves judgement over Imran’s right of defence

Trial court had rejected all of Imran Khan's witnesses

The Islamabad High Court reserved judgement in an appeal filed by Imran Khan regarding the denial to right of defence on Thursday.

Imran’s counsel Khawaja Haris told the court that the trial court had refused to allow the PTI chief’s witnesses to be included in the case, calling them irrelevant to the case. He said that the ruling had been challenged infront of the IHC on the grounds that the witnesses were tax consultants and accountants who had knowledge of the matter.

He added that the trial court had dismissed the lsit of witnesses in a single day.

Chief Justice Aamer Farooq reserved decision in the case after hearing the arguments.

Imran Khan had challenged the trial court’s order of Wednesday in the IHC and asked for his appeal to be heard immediately as Session Judge Humayun Dilawar had indicated that decision would be reserved in the case on Thursday.

The PTI chief had presented the names of tax consultant Muhammad Usman Ali, senior manager Qadeer Ahmed, ITP manager Naveed Fareed as well as party member Raoof Hassan as witnesses in the trial court.

However, the Election Commission of Pakistan’s lawyer Amjad Pervez said that the witnesses were not relevant to the case.

The court had then ruled that Imran Khan’s right of defence was struck down as he had failed to effectively link his witnesses to the case.

Judge Humayun Dilawar had ruled that all witnesses were tax consultants or accountants while the case against Imran Khan was filed under the election act and not the income tax ordinance.
