Husband gets six month imprisonment for marrying without permission

Husband was sent to jail for six months and handed a Rs0.5 million fine for getting married for without permission from his first wife.

This interesting marriage took place in Bahawalpur, where a family court Judge Muhammad Asim Shafiq heard the case filed by his wife.

According to the court order, the accused Chaudhry Niaz will have to serve two more months in jail for non-payment of the fine. After the judgment, Niaz was shifted to New Central Jail Bahawalpur.

According to the petition, they got married on November 03, 2019, however, the accused tied the knot on February 19, 2021, without seeking permission from his first wife.

In 2020, the Supreme Court of Pakistan ruled on a petition related to Nikah, saying that it is necessary to take the permission of the first wife or mediation council before the second marriage so that balance can be maintained in society.

Referring to Section 6 of the Muslim Family Laws Ordinance, 1961, the Supreme Court made it clear that “second marriage is not prohibited under this section”. ’

This is not the first time that someone has been sent to jail for remarrying without permission. A similar decision was given by the Khairpur court.

Judge Zafarullah Jakrani of the Civil Court of Subho Dero tehsil of Khairpur, while announcing the verdict in the case, sentenced accused Lal Bakhsh to six months imprisonment and imposed a fine of Rs 5,000 for not taking permission from his first wife and shifted him to Central Jail Khairpur.
