CJP's haste in appointing SC judges questionable: Justice Qazi Faiz Isa

Says as soon as he left Pakistan CJ decided to hold meetings of the JCP to consider appointments

Justice Qazi Faiz Isa has criticized Chief Justice Umar Ata Bandiyal for convening a meeting to appoint Supreme Court judges, saying that the chief justice wanted to make "wholescale appointments hurriedly."

"While on my annual leave I received a WhatsApp message from the Additional Registrar of the Supreme Court informing that the Hon'ble Chief Justice of Pakistan has convened a meeting of the JCP on July 28, 2022 to consider the appointment of five judges to the SC," Justice Isa stated in his letter to the Judicial Commission of Pakistan.

He said that no meeting of the JCP was scheduled before he had applied for annual leave but as soon as he left Pakistan the CJ decided to hold two meetings of the JCP to consider appointments to the Sindh and Lahore High Courts.

"The summer vacations of the SC were notified by the CJ himself and then these were gazetted in the Official Gazette," he said and added that if the chief justice rendered his own notification utterly meaningless then let him first withdraw it, instead of violating it.

He said that he received a WhatsApp message consisting of 2,347 pages of documents about the nomination of judges.

In his letter, Justice Isa said that the Chief Justice's haste in appointing judges was questionable.

“The CJ wants to rush through a most delicate matter and in one week, he wants 2,347 pages of documents to be reviewed,” he stated.

He lamented that he could only access and read 14 out of the 2,347 pages, making it impossible for him to view all of them.

"These documents were neither couriered to me nor sent through the embassy," he added.

Justice Isa requested the chief justice to postpone the meeting which was scheduled to be held on July 28.
