Musharraf’s medical report presented before Special Court

ISLAMABAD: A sealed medical report of former president General (retd) Pervez Musharraf was presented before the Special Court here on Tuesday.

The three-judge court headed by Justice Faisal Arab decided that the court would consider the report on Thursday.

The court directed the registrar to provide copies of the report to Musharraf's counsel and the prosecution team and exempted him (Musharraf) for appearance for further two days.

The Special Court is conducting the high treason trial under Article 6 of the Constitution in the National Library. Tuesday's was the fifth hearing.

However, Pervez Musharraf has not yet appeared before the court despite court's repeated orders. Musharraf was rushed to the Armed Forces Institute of Cardiology (AFIC) Rawalpindi on January 2 when he claimed to have suffered heart problem on his way to attend the court's proceedings.

Meanwhile, during the course of proceedings, Musharraf's counsel Anwar Mansoor argued that the court had limited jurisdiction.

Mansoor maintained that the court could not interpret laws or go in technicalities on certain issues as it had limited powers.

He contended that there was no such provision of arresting the accused in Pakistan Penal Code (PPC) or in the Constitution. The Special Court has been established under special laws and neither the PPC nor the Constitution can be applied on it, he added.

Later, the case was adjourned till January 8 (Wednesday).
