SC elaborates six options to act over non-implementation of NRO decision

The Supreme Court on Tuesday elaborated six options which it might exercise over non-implementation of its directives contained in detailed judgments of December 16, 2009, on annulled National Reconciliation Ordinance (NRO).

A special bench comprising Justice Asif Saeed Khan Khosa,Justice Ejaz Afzal Khan, Justice Ijaz Ahmed Chaudhry, Justice Gulzar Ahmed and Justice Muhammad Ather Saeed directed the Attorney General for Pakistan (AG) Molvi Anwarul Haq to convey these options to the concerned authorities.

The bench directed Attorney-General to put his arguments before the Court on January 16, over the issue after obtaining instructions from the authorities concerned.

The bench in its order also asked the AG to apprise as to why any of the options might not be exercised by the Court in these matters.

The bench also granted a hearing opportunity to those who might be affected from their exercise of options. "It goes without saying that any person likely to be affected by exercise of these options may appear before this Court on the next date of hearing and address this Court in the relevant regard so that he may not be able to complain in future that he had been condemned by this Court unheard," it observed.

The AG was also directed to inform all the concerned persons about the passage of the order and also about the next date of hearing. The bench also referred the case to the Chief Justice of Pakistan for constitution of a larger bench on account of constitutional importance of these matters.

The bench also directed AG, Secretary Law, Justice and Human Rights Division, Chairman National Accountability Bureau and the Prosecutor-General Accountability shall appear before this Court in person.
