The Supreme Court of Pakistan has overturned the death sentence of Hamidullah, convicted in the 2008 Wah Cantt suicide attack case. A three-judge bench, headed by Justice Athar Minallah, accepted Hamidullah’s appeal, declaring the Lahore High Court’s Rawalpindi bench verdict null and void.
Hamidullah’s lawyer argued that his client was wrongly accused. He highlighted inconsistencies in the prosecution’s narrative, pointing out that while the FIR was registered 20 minutes after the attack, Hamidullah was reportedly apprehended in FATA (Federally Administered Tribal Areas) within that timeframe. The lawyer questioned the feasibility of apprehending a suspect in FATA and bringing him to justice within such a short period following the attack in Wah Cantt.
Justice Athar Minallah remarked during the hearing that flawed investigations often lead to accusations being wrongly placed on the courts.
The Supreme Court, citing the deficient investigation, acquitted Hamidullah. A detailed judgment will be issued later.
Lahore High Court’s Rawalpindi bench had previously sentenced Hamidullah to death for his involvement in the 2008 Wah Cantt suicide attack. Hamidullah was arrested in connection with the attack, which resulted in significant casualties.
