ISLAMABAD: A five member larger bench on Tuesday headed by Justice Asif Saaed Khaosa resumed hearing of Panama papers case against Prime Minister Nawaz Sharif, Aaj News reported.Â
Taufiq Asif, the counsel of Jamaat-e-Islami, on Tuesday concluded his arguments in today's hearing.
While presenting arguments, JI lawyers talked about the Zafar Ali Shah case. "The decision [in the Zafar Ali Shah case] had said that the London flats belong to the Sharif family," he said. On which, the bench reminded the lawyer that the decision reached in the Zafar Ali Shah case did not acknowledge Prime Minister Nawaz Sharif's ownership of the London flats.
Asif further insisted that "I will establish that Khalid Anwar was the defending lawyer for Nawaz Sharif".
The bench expressed anger, Justice Khosa remarked, "Tell us the court's findings, do not tell us what the lawyer's position was."
Who was Khalid Anwar representing in the case?" Justice Sheikh Azmat asked. "No, you do not even know. You have not even read the court's decision but are [insisting on] referring to it." Justice Azmat further raged.
Justice Azmat Saaed further remarked, "You have caused as much damage to your client as you possibly could."
The court told the lawyer that he had not been able to establish any relationship between the references he was making and the ownership of the London flats.
Justice Khosa observed, "One thing is clear: the London flats were not mentioned in that decision."
Concluding his arguments, JI's counsel talked about Gulf Steel Mills, saying that there are serious doubts regarding the Dubai mill. Then Justice Khosa asked the lawyer, "What good will come from these doubts?"
Asif anwered that he suspects the London flats were bought by selling the Gulf Steel Mills and PM should present himself for cross-examination.
The bench then told that they would decide on the matter after receiving all the arguments.
"If there is a need, we will call Nawaz Sharif to present himself in court",the bench assured.
After the submission of arguments by JI's counsel, Maryam Nawaz's lawyer Shahid Hamid submitted a written reply which claimed that the gifts her father had given her were a token of his paternal love.
The reply stated that Maryam was not the owner of the London flats, and that the Park Lane flats were owned by her brother, Hussain Nawaz.
However, the court rejected the document, claimed that the document containing Maryam Nawaz's testimony does not have her signature on it. The lawyer will again submit the documents after getting it signed.
The court later adjourned hearing till tomorrow (Wednesday).
Advancing arguments in the Panamagate case on Monday, the Jamaat-e-Islami counsel said that the onus of proof in the matter lies with Prime Minister Nawaz Sharif. Justice Asif Saeed Khan Khosa observed that the counsel for Nawaz Sharif had earlier declined to produce the money trail on grounds that his client has nothing to do with the Mayfair properties in London. Taufeeq Asif argued that after defending his children on the floor of the Lower House, Prime Minster Nawaz Sharif had submitted documents before the apex court about details of 'money gifts' which he received and gave to his children.
The counsels of the Prime Minister and the PTI have already completed their arguments in the case.
