A petition seeking to overturn Imran Khan’s conviction in the Toshakhana case was filed in the Supreme Court on Monday.

The petition was filed by Advocate Saima Safdar under Article 184(2) of the constitution.

Judge Humayun Dilawar, who announced the order convicting Imran, has also been made a party in the case as well as the government.

The petition asks the court to order a retrial of the case as Imran Khan was not accorded a free trial. The petition says that the proceedings violated Articl 10A and must be declared null and void. It also says that the retrial should uphold the principles of natural justice.

The petition also argues that the case involves a ‘prime public figure’ so the violation of his right to fair trial could contirbute to the law and order situation.

Imran was sentenced to three years in prison and slapped with a Rs100,000 fine over corrupt practices in the Toshakhana case on Saturday. He was also disqualified from holding a public office for five years. The judge had written that Imran’s crimes had been proven ‘beyond doubt’.
