Justice Mazahar Naqvi challenges SJC proceedings

Hours before the Supreme Judicial Council (SJC) meeting took up complaints of misconduct filed against him, Justice Mazahar Naqvi has approached the Supreme Court to stop proceedings against him.

Justice Naqvi approached the SC early on Monday, asking for proceedings against him in the SJC to be brought to an end.

The judge said that the Council had sent him notices without hearing his objections and asked the SC to declare any notices for future hearings to be illegal as well.

He maintained in his application that the proceedings against him were an attack on the judiciary.

Headed by Chief Justice Qazi Faez Isa, the meeting will look into allegations against Justice Mazahar Naqvi and Justice Tariq Masood.

Sources said that objections raised by Justice Naqvi against the members of the SJC will also be reviewed on Monday.

The SJC had sent a show-cause notice to Justice Naqvi over allegations of misconduct and corruption filed against him on October 27.

However, the judge had responded by raising objections to the participation of the CJP and two other judges in the hearing.

He had also said that the proceedings against him were ‘politically motivated’ and not legal.

“In the interest of propriety, justice, and fairness, Mr. Chief Justice Qazi Faez Isa and Mr. Justice Naeem Akhtar Afghan ought not to hear the complaints against me.

“Their participation in the proceedings resulting in a Show Cause Notice being issued to me taints those proceedings, inter alia, with bias and makes all orders passed in such proceedings as being without lawful authority and of no legal effect,” Justice Naqvi had said.
