The review petition was filed against the judgment of 14-member larger bench which declared the proclamation of Emergency of November 3, of 2007 as un-constitutional.

Musharraf in its review petition took the stance that judgment was per-incurium, void, coram non-judice and no proper lis.

He said that he was not heard which would be against the basic principle of administration of justice.

He said that without affording him sufficient, proper and reasonable opportunity of being heard, the judgment is liable to be reviewed and set aside.

It was also stated that the 14-member larger bench in its short order had not directed for trial of Musharaf for the offence of high treason.

Musharraf prayed the apex court to suspend the operation of the impugned judgment and consequently the proceeding of high treason trial may also be stayed before the Special Court, until the outcome of this review petition.

He also took the plea that it was the first review petition on behalf of Musharrf as before that some aggrieved judges earlier had filed review petition against the said judgment.

The petition was settled by S Sharif-ud-Din Pirzada, Raja Muhammad Ibrahim Satti, and Dr. Khalid Ranja Senior Advocates of the Supreme Court.
