Petition filed for contempt of court against DG ISPR

The petition was filed by, advocate Tariq Asad, who is also the lawyer for the prisoners who died while in custody of intelligence agencies, plead the court to register contempt proceedings against Maj Gen Athar Abbas for his alleged interference in a sub judicial matter regarding the illegal detainment of 11 prisoners of Rawalpindi’s Adiala Jail, who are now missing.

In his petition, Advocate Tariq stated that Maj Gen Abbas had issued a press release to the media, portraying a false picture of justice being served.

He claimed that contents of the press release were fabricated and the alleged parties i.e. the Inter-Services Intelligence (ISI) and Military Intelligence (MI) were continuously portraying a false picture through to the media and undermining the court’s authority.

The petition stated, "After the acquittal of the accused, the respondents had the option of filing appeal in competent courts, but instead abducted the accused from the Adiyala Jail and kept them in illegal confinement for almost 21 months as witnessed from the ‘Daily Situation Report’.”

“If the accused were acquitted by the courts, nobody, no institution, no organ of the state, even the parliament or the executive, can raise fingers that somebody who has been acquitted is a criminal.”

The Attorney General Pakistan Maulvi Anwar Ul Haq will submit records and evidence detailing the long-hauled detention periods and  Raja Muhammad Irshad, lawyer for the Inter-service Intelligence (ISI) and Military Intelligence (MI) to submit his records and statements along with the attorney general’s.

The Khyber-Pakhtunkhwa chief secretary was also told to collect the relevant records briefing the circumstances under which the detainees were allowed to be held captives in Parachinar Internment camp.
