AQ Khans case: IHC dismisses contempt petition

A single member bench of Chief Justice Sardar Muhammad Aslam after hearing the arguments of petitioner’s counsel dismissed the petition by saying that the petitioner has no Locus Standi to file a petition.
The petitioner Muhammad Iftikhar Husain had filed the petition against President Pervez Musharraf, Information Minister Sherry Rahman, Interior Secretary Kamal Shah, Attorney General Malik Qayyum, Deputy Attorney General Raja Abdur Rehman, advocate Ahmer Bilal Sufi.
The registrar of the court, however, had returned the petition by saying that a contempt petition cannot be moved against the president. Mohammad Iftikhar Hussain, president of human rights group Tehrik e Insanyat, then filed an application through his counsel Barrister M Javed Iqbal Jafferi before the Chief Justice.
M Javed Iqbal Jafferi arguing against the objections of the registrar said that there should be same law for every one in the country and the president has no indemnity according to Islamic law.
The chief justice after the arguments reserved the decision on the registrars’ objection for some time but later dismissed the petition.
The IHC on July 21 had barred Dr Abdul Qadeer Khan from speaking on the nuclear proliferation issue, but had allowed him to meet relatives and travel inside the country after security clearance.
