Sources said the letter was written by Justice Shah a day before the recent meeting of the Judicial Commission.

According to the contents of the letter, Justice Shah stated that no consultation was held with the Chief Justice or other relevant authorities on a matter as sensitive as judicial seniority, which he described as a violation of constitutional requirements.

Justice Shah emphasized that under Article 200 of the Constitution, the President is bound to consult the Chief Justice in such matters. However, the seniority determination was carried out unilaterally and in haste, bypassing the required consultation process.

The letter also pointed out that the seniority issue is already pending in an intra-court appeal, making any unilateral decision inappropriate. Justice Shah stressed that formal consultation on such an important matter was essential and could not be overlooked.
