The court accepted the appeals of both defendants, granting them the benefit of the doubt and nullifying the previous decision made by the trial court, thus ordering their release.

The ruling was delivered by a bench led by Justice Shahran Sarwar Chaudhry and Justice Sardar Akbar Dogar.

The judgment highlighted allegations from the complainant that the deceased’s wife had an illicit affair with the accused, Dilawar, which the husband had forbidden.

According to the prosecution, the wife, Hina, and Dilawar had attended a wedding ceremony together, after which Munir Ahmed, the husband, did not return. His body was later discovered during a search.

The prosecution argued that the defendants, alongside two unidentified individuals, had plotted the murder. However, the court concluded that there were no eyewitnesses to the incident, and the prosecution had not successfully proven its case.

The court referenced the legal principle that any doubt in a case should benefit the defendant.

As a result, the Lahore High Court rescinded the death sentence imposed by the trial court in 2021 and ordered the release of the accused.

It should be noted that the Sargodha police had registered the murder case concerning the deceased in 2019.
