Plea filed in SC to suspend military trials of May 9 suspects

A petition was filed in the Supreme Court on Sunday against the military trial of those allegedly responsible for May 9 events—when protesters vandalised state properties and military installations after PTI Chairman Imran Khan was first arrested in a graft case.

Shahid Nawaz, brother of suspect Yasir Nawaz, in his petition, cited that it was “unconstitutional” to try suspects under military courts.

The development comes on the day when the federal government submitted its reply to the apex court that civilian trials in military courts have already been started.

A five-member bench of the SC would take up petitions against the trial of civilians involved in May 9 in military courts on Monday (tomorrow).

The petitioner feared that the military courts had started the trial of suspects of May 9 violence.

Shahid said that civilians were tried in military courts under peaceful circumstances, adding that military trial of civilians was contrary to constitutional guarantees.

He demanded that the detention of suspects under the military authority and military trial of suspects should be declared “unconstitutional”.

The trial of the civilians under Section 2(1)(d)(ii) and Section 59’s sub-section 4 of the Army Act should be declared “unconstitutional”, the petitioner added.

The decision of the trial in the military court should be suspended until the decision of the Supreme Court, Shahid said.
