The appeal has been assigned a number but has not been assigned a date. No objections were raised by the registrar.

Imran Khan had filed an appeal asking the court to nullify a decision of the Islamabad High Court that sent the Toshakhana case back to a trial court and ordered that the case be heard within seven days.

The PTI chairman has argued that a single-member bench of the court decided the case which is against the interest of justice and impartiality. He has also argued that he was indicted in the case while in illegal custody and sending the case back to the same judge indicates malintent.

He also argued that accepting the Election Commission’s request for criminal trial is against the law.

Imran Khan had earlier filed a request in the Islamabad High court to get his indictment and the case quashed. He had also filed a case expressing lack of trust in IHC Chief Justice Aamer Farooq.

However, the judge had ruled that while the indictment seemed to have been made in a hurry, the case should be sent back to the trial court where Imran Khan’s lawyer would present his arguments again.
