SC sources explain sudden absence of CJP Bandial

In a sudden move, the Supreme Court cases before benches headed by Chief Justice of Pakistan Umar Ata Bandial have been delisted, Aaj News reported on Wednesday.

Justice Jamal Mandokhel and Justice Athar Minallah were also part of the Bench No. 1. A notification in this regard has also been issued by the Registrar Office of the Supreme Court.

They were scheduled to hear 12 cases today (Wednesday).

According to the spokesman of the Supreme Court, due to the non-availability of Chief Justice Umar Ata Bandial, the cases of Bench-I were delisted.

“It is to inform that the Court Roster regarding Bench-I for Wednesday, April 26, has been revised due to the indisposition of the Hon’ble Chief Justice of Pakistan”, says the statement issued by SC PRO.

Sources said that CJP could not come to the apex court due to ill health, the doctor has also examined him at his residence.

The security squad that used to take the Chief Justice to the Supreme Court has also been sent back.

It is worth mentioning here that the Chief Justice arrived in Islamabad from Lahore yesterday (Tuesday).

Moreover, cases before the bench comprising Justice Sardar Tariq Masood and Justice Shahid Waheed have also been delisted.

The Registrar Office has released a fresh list of cases for the new Bench-II.

Now, the new Bench-II will comprise Justice Ijaz ul Ahsan and Justice Aminuddin Khan will hear the fresh list of cases at 9:30. Thereafter Justice Ijaz will head a three-member bench at 11:30 AM.

The move comes after the bill was passed by the Parliament twice earlier this month but an eight-member Supreme Court bench passed an order against it declaring that the moment the act comes into being it will be suspended.

The government, however, notified the bill into law on April 21 just before the Eid holidays began.

The new laws clips some of the power enjoyed exclusively by the CJP and redistributes among the CJP and the two most senior judges of the Supreme Court of Pakistan.

The powers include the authority to constitute court benches and the privilege to take suo motu notice under Article 184(3) of the Constitution.
